Expert Witness

An expert witness in Hong Kong is appointed and instructed by either one of the parties in a dispute (the party appointed expert) or jointly by the parties involved in a dispute (the single joint expert). The primary duty of the expert witness is to assist the Courts or a tribunal on issues within his field of expertise. This obligation overrides any obligation to the parties from whom the expert has received instructions or by whom he has been paid.

• The valuation of variations, contra charges and defective work;

• Adverse ground conditions including those arising out of differing site condition clauses and Geotechnical Baseline Reports (GBR);

• Construction insurance claims, specifically those arising out of Contractor's All Risk (CAR), Third Party Liability, Product Liability and Professional Indemnity Insurance (PII) policies.
